Suing for safe sidewalks
Safe sidewalks lawsuit plaintiff: "I'm not going out in the street for the fun of it…"
61-year old Long Beach, California resident, Ben Rockwell is used to vehicles roaring past his wheel chair… with only
"inches" to spare.
He says he often has no choice but to take to the streets… because he can't get around poles and other sidewalk
obstacles.
Many curb cuts and slopes do not comply with the law, he is often in danger of tipping over on dangerously slanted
rights of way.
Safe sidewalks lawsuit plaintiff: "the lack of access that these things… shopping … transportation… lack of access
of being able to go and enjoy all the things that my able-bodied friends are able to enjoy makes me feel less like a
whole human. It takes away from the independence that everyone wants to have…"
AARP foundation litigation attorneys are serving as co-counsel in Californians for disability rights, inc. Et al. V.
California department of transportation.
And other advocates for the aging and physically challenged are watching this case carefully… and gaging the impact
of its outcome on municipalities across the country.
